Terms of Service

1. Acceptance of Terms

By accessing or using Ask Wisdom (the "Service"), operated by Ask Wisdom ("we," "us," "our"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your continued use constitutes acceptance of any modifications.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement and have full legal capacity to enter into this agreement.

3. Nature of the Service — Not Professional Advice

THE SERVICE IS PROVIDED FOR REFLECTIVE, EDUCATIONAL, AND CONTEMPLATIVE PURPOSES ONLY. IT IS NOT, AND IS NOT INTENDED AS, A SUBSTITUTE FOR PROFESSIONAL ADVICE OF ANY KIND.

Responses provided by contemplative teachers, monks, or other practitioners ("Teachers") on the Service do not constitute, and shall not be construed as, medical, mental health, psychological, psychiatric, legal, financial, tax, religious, or other professional advice, diagnosis, or treatment. Teachers are not licensed therapists, physicians, attorneys, or financial advisors unless explicitly stated, and even then they are not acting in such capacity through the Service.

If you are experiencing a medical or mental health emergency, including thoughts of self-harm or suicide, you must immediately contact emergency services (such as 911 in the United States) or a crisis hotline (such as 988 in the United States). Do not rely on the Service for emergency or urgent care.

4. User Content and License

You retain ownership of the questions, recordings, and other content you submit ("User Content"). By submitting User Content, you grant Ask Wisdom a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, transmit, display, and use your User Content solely for the purpose of operating, providing, improving, and promoting the Service, including delivering it to Teachers for response.

You represent and warrant that (a) you own or have the necessary rights to submit your User Content, and (b) your User Content does not violate any law or third-party right.

5. Teacher Responses

Responses created by Teachers ("Responses") are the personal reflections and opinions of those individuals. We do not endorse, verify, or guarantee the accuracy, completeness, or suitability of any Response. Responses are licensed to you for personal, non-commercial use only. You may not republish, redistribute, sell, or use Responses for training any artificial intelligence or machine-learning system without our prior written consent.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful, harmful, harassing, defamatory, or fraudulent purpose; (b) submit content that is obscene, threatening, or infringing; (c) attempt to gain unauthorized access to any portion of the Service; (d) interfere with or disrupt the Service; (e) reverse engineer, scrape, or harvest data from the Service; (f) impersonate any person; or (g) use the Service in any manner that could damage or overburden it.

7. Accounts and Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss arising from your failure to maintain account security.

8. Intellectual Property

The Service, including all software, design, text, graphics, and trademarks, is owned by Ask Wisdom or its licensors and is protected by intellectual property laws. No license is granted to you except as expressly set forth in these Terms.

9. DISCLAIMERS — "AS IS"

THE SERVICE AND ALL RESPONSES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE MAKE NO REPRESENTATION OR WARRANTY THAT ANY RESPONSE WILL PRODUCE ANY PARTICULAR OUTCOME, RESULT, OR BENEFIT. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE AND ANY RELIANCE ON ANY RESPONSE.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASK WISDOM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, OR TEACHERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY RESPONSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ask Wisdom and its affiliates, officers, directors, employees, agents, contractors, and Teachers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

12. Assumption of Risk and Release

You acknowledge that engaging with contemplative or spiritual content may evoke strong emotional, psychological, or physical responses. You voluntarily assume all risks associated with your use of the Service and any reliance on Responses. You hereby release Ask Wisdom and its Teachers from any and all claims, demands, and causes of action arising from such use to the fullest extent permitted by law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Sections 4–6 and 8–17 survive termination.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Subject to Section 15, the exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction therein.

15. Binding Arbitration; Class Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Francisco, California, in English. Judgment on the award may be entered in any court of competent jurisdiction.

YOU AND ASK WISDOM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

You may opt out of this arbitration agreement by sending written notice to the contact address below within thirty (30) days of first accepting these Terms.

16. Changes to These Terms

We may modify these Terms at any time by posting the revised version on the Service. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

17. Miscellaneous

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Ask Wisdom regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign freely.
